Terms of use

1. Acceptance

By using the Gofresh app, website, or services (“Gofresh”, “we”, “our”), you agree to these Terms of Use. If you do not agree, please do not use Gofresh.

2. Service Description

Gofresh connects customers (“Users”) with partner stores (“Stores”) and delivery partners (“Riders”) to order and receive goods such as groceries. Gofresh is a platform provider, we do not manufacture, own, or warrant products sold by Stores, and we are not responsible for interactions between Users, Stores, and Riders beyond our platform policies and applicable law.

3. Store/Rider Verification

Stores and Riders may be required to provide accurate information and documentation for verification (e.g., business details, identification, vehicle details where applicable). Submitting false or misleading information is prohibited and may result in suspension or termination.

4. User Conduct

  • No harassment, fraud, abuse, or prohibited items/orders.
  • Users must provide accurate delivery and contact information and pay applicable charges.
  • Stores must prepare accurate orders, respect availability, and comply with food/product safety rules.
  • Riders must follow road safety laws and handle items with care.
  • All parties must act respectfully and comply with these Terms and applicable law.

5. Payment & Fees

  • Users may pay by card, wallet, or cash on delivery (where available). Prices and fees are shown at checkout.
  • For home delivery orders, Stores are credited after the Rider completes delivery. For store pickups, Stores are credited after confirming customer collection.
  • Gofresh may charge service, delivery, or platform fees. Store commissions and Rider payouts are displayed in their respective dashboards.
  • Wallet refunds (where applicable) are processed to the User’s Gofresh wallet according to our cancellation policy.

6. Cancellations & Refunds

  • Users may cancel subject to the order status. If preparation or pickup is already in progress, fees may apply.
  • Eligible refunds are credited to the User’s wallet or original payment method (as available). Refund timing may vary by payment provider.
  • Stores may decline orders (e.g., out-of-stock). In such cases, Users will not be charged, or amounts will be refunded/voided.
  • Riders may cancel only for valid reasons (e.g., safety). Abuse of cancellations may lead to account action.

7. Suspension or Termination

Gofresh may suspend or terminate access for violations of these Terms, unsafe behavior, fraud, non-compliance with law or platform policies, or other risks to Users, Stores, Riders, or Gofresh.

8. Liability Disclaimer

  • Gofresh is not liable for product quality issues attributable to Stores, or for delays caused by traffic, weather, or other external events.
  • We are not responsible for loss, theft, or damage after delivery/pickup confirmation.
  • Offline transactions or arrangements made outside the app are not covered by Gofresh.
  • To the maximum extent permitted by law, Gofresh’s liability is limited to amounts paid to us for the specific order giving rise to the claim.

9. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Venue and jurisdiction will be as provided by applicable Nigerian law.
